The ordinance reads that it is "unlawful for the owner to permit any weeds, or grass, edible or not, to grow to a height exceeding ten (10) inches anywhere on such premises." It applies whether or not anyone lives there, vacant lots and rental properties included.
The code also names specific plants that are not allowed to stand regardless of height:
- Thistle
- Jimson
- Burdock
- Ragweed
- Poison hemlock
There are real exemptions, and they matter if you own acreage. A property over one acre that is known to be non-buildable only has to keep an eight-foot buffer where it meets developed property. Agricultural land is exempt. And deliberate native plantings for naturalisation are permitted if they're properly maintained: a wildflower meadow is not a violation; a neglected one can be.
Enforcement runs through a code enforcement board rather than a court, under KRS 65.8801 to 65.8839.
This is a plain-English summary, not legal advice. The code changes, and your situation may fall under an exemption or an overlay we can't see from a photo. For what applies to your specific address, call LFUCG Code Enforcement on (859) 258-3091 or read §12-2 in full
